The lawsuit alleges that Defendant conspired to decrease the supply of eggs that in turn caused direct

purchasers of shell eggs to pay more than they should have.


The Settlement is for the benefit of direct egg purchasers only, that is, entities or individuals in the United States who bought eggs directly from Michael Foods, and not those who purchased eggs indirectly such as from wholesalers, distributors, or retailers. To be eligible to share in the Settlement, you must have purchased Shell Eggs.

Excluded from the Class are Defendants, their co-conspirators, and their respective parents, subsidiaries and affiliates, as well as any government entities. Also excluded from the Class are purchases of “specialty” shell eggs (such as “organic,” “certified organic,” “free range,” “cage free,” “nutritionally enhanced,” or “vegetarian fed”) and purchasers of hatching eggs, which are used by poultry breeders to produce breeder stock or growing stock for laying hens or meat.
